Terms of Service

1. Agreement to these terms

By creating an account or using Outbound Suite pro ("the Service"), you agree to these Terms of Service and to our Privacy Policy, Anti-Spam Policy and any other policies referenced here. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the confidentiality of your credentials, for all activity under your account, and for keeping your account information accurate. You may not share accounts, or access the Service with credentials you are not authorised to use.

3. The Service

Outbound Suite pro provides a platform for managing leads, building multi-step email sequences, connecting your own SMTP accounts, launching campaigns, tracking delivery, and collecting newsletter subscribers through embeddable forms. The Service is provided on a subscription basis subject to plan limits, which may change with notice.

4. Your responsibilities

• You are solely responsible for the content you upload and the messages you send.
• You must comply with all applicable laws, including anti-spam laws (e.g. CAN-SPAM, GDPR, UK GDPR, CASL) and must have a lawful basis for every recipient you contact.
• You must not use the Service to send unlawful, fraudulent, deceptive or harassing content, or to transmit malware or phishing material.
• You must keep your contact lists clean and honour unsubscribe requests promptly.

5. Sending accounts and deliverability

You connect your own email/SMTP accounts and remain responsible for them, including compliance with that provider's terms. We rotate accounts and provide analytics to help protect deliverability, but we do not guarantee deliverability, inbox placement or a specific open/reply rate.

6. Fees and billing

Paid plans are billed through Stripe in advance on a monthly basis unless stated otherwise. Fees are non-refundable except as required by law. You authorise us to charge the payment method on file. We may change prices with reasonable notice; changes apply to subsequent billing periods. Free-plan limits and any trial period are described on the pricing page.

7. Cancellation and termination

You may cancel from your billing portal at any time; access continues until the end of the current period. We may suspend or terminate accounts for breach of these Terms or our Anti-Spam Policy, for non-payment, or to protect the platform and other users. Upon termination your right to use the Service ends; we may retain data as described in our Privacy Policy.

8. Intellectual property

The Service, its software, design, marks and content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You retain ownership of the data and content you upload, and grant us a licence to process it solely to provide the Service.

9. Third-party services

The Service integrates with third parties such as Stripe and the SMTP providers you connect. Those services are governed by their own terms and privacy policies, and we are not responsible for them.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Outbound Suite pro AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, BUSINESS OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Outbound Suite pro and its affiliates from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or any law.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Outbound Suite pro is established, without regard to conflict-of-law rules, and any dispute will be resolved in the competent courts of that jurisdiction.
